Weinig Holz-Her USA, Inc. (the “Company”), a North Carolina corporation, is pleased to be conducting this giveaway (the “Giveaway”). In order to participate in the Giveaway, you must agree to these terms and conditions (“Rules”).

PLEASE CAREFULLY READ THE RULES OF THE GIVEAWAY. THE RULES CONTAIN IMPORTANT PROVISIONS ABOUT THE GIVEAWAY AND THE COMPANY’S OBLIGATIONS WITH RESPECT TO THE GIVEAWAY. YOUR PURCHASE OF A GIVEAWAY TICKET CONSTITUTES YOUR ACCEPTANCE OF THESE RULES. ELIGIBILITY IS LIMITED, AND THIS GIVEAWAY IS VOID WHERE PROHIBITED.

Purpose. The purpose of the Giveaway is to offer a prize as part of a training program organized by the Company.  The Giveaway is being lawfully conducted pursuant to N.C. Gen. Stat. 14-309.15. The Company is the sponsor of the Giveaway and is located at 124 Crosslake Park Drive, Mooresville, North Carolina 28117. 

 

How To Enter. To enter the Giveaway, you must obtain a Giveaway ticket in-person at the Oktoberfest Check-In or online at www.weinigholzher.com/Oktoberfest-GiveAway-Edgebander by following the link at the bottom of the page. You will place your Giveaway ticket in the designated entry location for the 1057XLC (the “Prize”). The Company is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted, or garbled entries, which will be disqualified. Proof of submission will not be deemed to be proof of receipt by the Company. The Company reserves the right to cancel or extend the Giveaway for the Prize at any time in its sole discretion.

How the Winners Are Selected. The Company will randomly select the winners from the pool of entries for each respective Prize (the “Winners”) at the drawing on October 26th at 1:00pm Eastern Time. The Winners do not have to be present to win. The Company will contact the Winner using the contact information provided in the winning submission and confirm that the Winner accepts the Prize Agreement, which includes an affidavit of eligibility, a liability release, and a publicity release (the “Prize Agreement”). If any Winner fails to respond to the Company within 4 hours after being contacted, proves to be ineligible under these Rules, or opts not to sign the Prize Agreement, that Winner will forfeit all claims and rights of any kind or nature to such Prize and the Company will select alternative Winners from the pool of entries until it finds a responsive, qualifying Winner who signs the Prize Agreement.

Prize and Prize Exchanges. The Prize is the 1057XLC Holz-Her Edgebander. Winning the Prize is contingent upon your fulfilling all the requirements in the Rules and signing the Prize Agreement. Failure to claim the Prize by the time or in the manner specified in that notification will invalidate any claim to the prize. The Prize is not transferable. EXCEPT AS OTHERWISE PROVIDED AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PRIZE IS PROVIDED “AS IS” AND IS NOT EXCHANGEABLE FOR FAIR MARKET VALUE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE PRIZE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Winner will be responsible for arranging for and paying the cost of transporting the Prize and the Company is not responsible for any damage to, or any loss of, any Prize in transit. No Prize may be redeemed or substituted for cash.  

Eligibility. The Giveaway is open to individuals who are (a) 18 years of age or older at time of entry and (b) a legal resident of one of the contiguous 48 states of the United States of America (“Entrants”). Each eligible person who obtains a Giveaway ticket shall be referred to herein as an “Entrant.” Employees, Dealers, Contractors, and volunteers of the Company and its affiliates and members of their immediate families (spouses, parents, siblings and children) are not eligible to enter or win. The Giveaway is subject to all applicable federal, state, and local laws and regulations and is VOID WHERE PROHIBITED. Obtaining a ticket constitutes an Entrant’s full and unconditional agreement to the Rules. The Company’s decisions relating to the Giveaway are final and binding in all matters relating to the Giveaway.

Odds of Winning. Your odds will depend on the number of tickets the Company distributes and how many tickets are entered for the Prize.  

Media. The Company may announce the Winner on its websites, Facebook Pages, Twitter accounts, or through other media, as it determine in its sole discretion. Winner agrees to the use of his/her name, address, photograph or videotape likeness and statements for publicity purposes by the Company, as contemplated by the Prize Agreement. Winner agrees to sign the Prize Agreement, including the publicity release, without any further compensation.

Taxes. The Winner will be solely responsible for all applicable taxes, fees, and surcharges associated with receipt and/or use of the Prize. If your Prize exceeds a retail value of $600, the Winner will be issued an IRS Form 1099-MISC.  The Company accepts no responsibility for the Winner’s tax obligations and recommends that the Winner consult with a tax advisor.

Delivery of Prize. The Winner will be solely responsible for any freight charges that incur upon delivery of the prize to the winner's location. Delivery of the prize must be arranged and completed within 3 months of winning the prize.

Disputes. The Giveaway and these Rules are governed by the laws of the State of North Carolina, without reference to any applicable choice of law provisions. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within Mecklenburg County, North Carolina. By entering the Giveaway, Entrants consent to the jurisdiction of the state courts of North Carolina and the federal courts located within North Carolina with respect to any action, dispute, or other matter pertaining to or arising out of the Giveaway. Entrants agree that (a) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred by them, including costs associated with entering this Giveaway, but in no event attorneys’ fees, and (b) under no circumstances will Entrants will be permitted to obtain awards for, and Entrants hereby waive all rights to claim, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. IN NO EVENT SHALL THE COMPANY’S AGGREGATE LIABILITY TO THE ENTRANT FOR ALL CLAIMS, WHETHER IN CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY EXCEED ONE HUNDRED ($100) DOLLARS. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

General Rules. The Company reserves the right to cancel the Giveaway at any time. Any failure by an Entrant to comply with any of these Rules may result in disqualification from the Giveaway. The Company has the sole and absolute discretion to disqualify any entrant. The Company is not responsible for any typographical errors in these Rules or in any other communication surrounding the Giveaway or for any technical malfunction or error relating to the Giveaway. The Company reserves the right to amend or interpret the Rules at any time, upon published notice to participants on its website. These Rules may not be waived, modified or supplemented except by the Company. By participating in the Giveaway, Entrants agree to release, indemnify, and hold harmless the Company and its directors, officers, employees and agents from any and all liability arising out of their participation in the Giveaway. Any attempt by an individual to undermine the legitimate operation of the Giveaway is a violation of criminal or civil laws. In the event such an attempt occurs, the Company reserves the right to seek damages from such individual to the fullest extent permitted by law. IN NO EVENT SHALL THE COMPANY HAVE ANY OBLIGATION OR LIABILITY WHATSOEVER IN RELATION TO THE GIVEAWAY OTHER THAN AS SET FORTH IN THESE RULES.
